Black soul gems are outlawed but they can contain both black and white souls. Black souls are the sentient souls, kajit, imperials, dark elfs, ect. It's easier to trap a soul with a weapon enchanted with soul trap but unless you dual wield, this can lead to wasting a lot of the weapons charge, fast, causing you to use your soul gems to recharge it.
